The Supreme Court on Wednesday directed the Deputy Commissioner of Ranchi to provide free education to the minor children of a Rape victim till they are 14 years old. Noting that a rape victim faces not only mental trauma but also discrimination from society, a bench of Justices Ashok Bhushan, Justice R. Subhash Reddy and Justice MR Shah also directed the Deputy Commissioner that Consider the case of the petitioner for providing housing under the Pradhan Mantri Awas Yojana (PMAY) or any other central or state scheme.
The bench said, “Senior Superintendent of Police, Ranchi and other competent officers will periodically review the police protection provided to the petitioner and take such steps as are appropriate and appropriate.” It said that the District Legal Services Authority, Ranchi will ensure proper legal service to the petitioner at the request of the petitioner to protect her interest. On the issue of payment of compensation to the petitioner as a rape victim, the apex court stated that Criminal Procedure Code 1973 in Jharkhand There is already a statutory scheme in force under Section 357A which provides the procedure for providing compensation.
The apex court said, “The petitioner had already applied for compensation under the said scheme and he has already received compensation.” The Supreme Court was hearing a petition filed by a woman who claimed to belong to a tribe in Jharkhand. A person had taken him with him. After this, her father lodged a complaint.
The person was later apprehended, but the victim’s father and the police got the accused and the woman married. The woman had filed a complaint against her husband and also demanded alimony, after which she got divorced and her son’s protection was given to the person. According to the case, on June 8, 2002, the woman went to meet her son in Daltonganj where she was raped by four men.
